Abandoned pool remains the same.

Contractors clearing the land are gone from the property. Archaeologists and surveyors have taken their place. The abandoned swimming pool remains the same.

The undrained swimming pool remains a matter of great concern for me. We use sump pumps routinely in this area, and draining the pool would be quite an easy thing to do. Removing the heavy plastic that is partially submerged under the surface of the pool could prevent a tragedy.

I urge the Code Enforcement Office to make it a priority. It is not, as they have characterized it, an attractive nuisance like every other pool in the city -- it is an abandoned pool, surrounded by brush and debris, and it is a public safety danger zone and a public health hazard!

I took photos to document the hazard of the abandoned swimming pool and will be sending them to the Mayor, requesting appropriate action.

Landscape work is apparently being done at the property, but nothing is being down to remedy the pool safety and health hazard. I called the Code Enforcement office to ask if the abandoned swimming pool could be a priority. I explained that children jump the fence to hunt for frogs, and it's full of stagnant standing water. She said there is a fence, and the pool is no more dangerous than any other pool in the city. She said it is an attractive nuisance regarding children, but they are trespassing on private property and when I see them there I should call the police. I was stunned!

Code Enforcement office reported that satff viewed the pool last year, and treated it with anti-mosquito donuts. "Resolution is dependent upon resolution of the estate," she explained, and now that the estate has been sold [it was sold in December '06], the office is working with the new owner to clean up the pool and attend to maintenance of the house and property. He is developing a plan and they will be meeting in two weeks...

I spoke with the Board of Health chairperson and he assured me that the matter was being taken care of. He looked at the pool and said standing water should be drained, and he would talk with Britta Mainello to be sure she is aware of the situation.

July 2007

Several times I called Code Enforcement to speak with someone about the pool. I mailed Britta Mainello a copy of the June 15, 2006 letter identifying the problem and assigning a complaint #. A office staff person called back and said the office is working on the case, i.e. they have scheduled a meeting with the new owner (new as of December 2006) in a couple of weeks.

Code enforcement was in the area, and they looked at the adandoned swimming pool. Tim Ahern said he thought it had been taken care of. We talked about how the property had been sold, and I explained that the new owner had been asked (by me) on two occasions to drain the pool, for safety and health reasons.

Called 652-4235, spoke with Mr. Coutrayer's office. The matter will be taken care of.

Sent email to inquire about draining the abandoned swimming pool. No answer.

June 15, 2006

I called the Code Enforcement Office to speak with them about the abandoned swimming pool on the Wick property.

I described the problem as follows: there is an abandoned swimming pool, with a low 4 ft fence around it that children can easily get over. When I see children there, I ask them to leave and explain that it is dangerous. But I am away from home often during the day, and this "attractive nuisance" hazard weighs on my mind.

There is a heavy plastic cover that is held by concrete blocks at the far end of the pool, opposite the diving board. The plastic has slipped into the pool at the diving board end, and it is partially submerged under the surface of the water. I am concerned that a child could slip and fall, get trapped under the plastic and drown.

Britta Mainello, Code Administrator, acknowledges receipt of complaint # 142738. George Coutrayer scheduled to conduct an initial investigation. She said I could phone him for additional information (allow 5 business days).
